Tax Preparer Caused $235,000 in Tax Loss to IRS

United States Attorney Richard S. Hartunian announced that Joyce Labombard, age 69, of Ellenburg Center, New York, pled guilty in US District Court in Utica, New York, on May 11, 2012, to one count of aiding and assisting in the preparation and presentation of a false and fraudulent return, in violation of Title 26, United States Code, Section 7206(s). Labombard is the owner of Country Side Tax, located in Ellenburg Center, New York.
In entering her plea, pursuant to a plea agreement, Labombard admitted she filed a false 2006 Amended US Income Tax Return on behalf of a client, which reported $4,976,560 in fraudulent deductions.
Through her plea agreement, Labombard also agreed to repay $19,187 in restitution to the IRS for taxes she owed for underreporting her business income from 2005-2008. The plea agreement also stated that the total tax loss caused by Labombard’s fraudulent conduct involving her own returns and those of others was $235,042.
A conviction of aiding and assisting in the preparation and presentation of a false and fraudulent return carries a maximum sentence of three years imprisonment and a fine up to $250,000, in addition to any restitution the court may order. Labombard is scheduled to be sentenced in October in Utica, New York. The court allowed her to remain free on conditions pending sentencing.
